Officials at the Virgin Johnson Academy of Excellence, a proposed multi-county charter school, are stunned by the denial of their application to join the S.C. Public Charter School District (SCPCSD).
The SCPCSD informed Fayette Nick, Chief Executive Officer for the VJAE, of its decision by telephone last Thursday, and said a letter would be coming to explain its decision.
"It's just blowing my mind," said Virgin Johnson, Jr., VJAE attorney and the son of the former educator and Hampton County Councilman who is lending his name and support to the proposed school. "This caught me by surprise, I'm shocked. We're all floored. I have no idea why, nobody knows why. I guess we'll have to wait and get the letter."
Jonathan Butcher, SCPCSD director of accountability, declined to comment on the application Tuesday, referring questions to District Superintendent Dr. Wayne Brazell. Brazell did not return phone calls by press time.
Nick released the following statement on Friday:
"The Virgin Johnson Academy of Excellence application for admission into the charter school district was denied by the charter school board, and we don't know why. A letter is supposed to be forthcoming within ten days.
"Our concern is that the state approved us, and an outside reviewer approved us, and the district denied us for whatever reason. The (VJAE) committee is now waiting for the letter to discuss their options.
"We want to thank the public for their support, we regret the outcome, and we tried our best to help raise the educational standards for children in this area."
Johnson said that in an earlier screening process the charter school passed evaluations by both the state advisory committee and an outside evaluator.
"We passed the state - where most people get weeded out - and they said we had a great application. But the district turned us down," he added. "The outside evaluators said we have a good application. There was never a problem with our application. If there was an issue, nobody told us. There may be a justifiable reason, but we don't know it."
A June 10 letter from Larry DiCenzo, chair of the South Carolina Charter School Advisory Committee (CSAC) to Brazell, a copy of which was provided to The Guardian by Nick, states that CSAC "has determined that the enclosed application ... complies with the standards set forth in Regulation 43-601, Procedures and Standards for Review of Charter School Applications, which reflect the requirements and intent of the Charter Schools Act."
A copy of the July 2 report from an outside evaluator, Wanda C. Whatley, Ph.D., rated VJAE as "good" and recommended that the SCPSCD "approve the application unconditionally."
Once the letter of denial is received, the VJAE will have 30 days to appeal this decision to an administrative law court. The court must hear the appeal and issue a final written order.
If the court affirms the district's denial, the school will not be approved. If it reverses the decision, the school can prepare to open the following year.
Nick said Monday that, in the worst-case scenario, VJAE would have to reapply to the state and the new school would have to open a year later than planned.
The proposed school is seeking to locate in Fairfax, but serve students from all surrounding counties. So far about 1,600 students, including 500 from Hampton County, have preregistered, Nick said.

Pastor Johnson (Virgin Johnson Academy)
The people are waiting on your direction. We are fasting and praying throughout the community. God has revealed that this is not the end but the beginning. We fully expect you to get Virgin Johnson Academy established in the community with the help of all mighty God. Pick up yourself as David did in Ziklag and go restore what God has promised. For you are fully equipped for the task. Release the power of God into the situation while the community continues to pray. Trust God it is not finished-keep going forward. Virgin Johnson Academy will open in 2011. This is just a test of your faith. You have feared this. Now cast off the fear.
Repeat: Statewide Charter School District Snob Academy
We are all disappointed, but we know what Mr. Johnson tried to do for children in this area was not a lie but work to give them a better future. In my book he is a hero for stepping out and trying to set up a charter school to help our children. So many of us complain about what’s going on in our schools but none of us have had the courage to put ourselves out there. Mr. Johnson is a retired teacher who made all segment of the community see a better future for their children. So The Virgin Johnson Academy School Board don’t deserve criticism but support for what they have tried do. I would still mortgage my home if it would make a difference. In my reading of the charter school law, they can still reapply, but why should they. The charter school district is the one who did something wrong. Virgin Johnson Academy is approved by the state; according to the charter school law after the state approval a school, it is suppose to be admitted to the statewide charter school district. Why weren’t they admitted? Because the Statewide Charter School District didn’t want any more poor black kids in the district. Whatever the statewide charter school district explanation, I know it will be a lie. The truth is that Virgin Johnson Academy is approved by the state and should have been admitted.
Outraged Over Virgin Johnson Academy
This is an outrage! Virgin Johnson Academy should have gotten approval from the charter school district. If something was wrong with the application the state department would have said so. The public charter school district is suppose to accept applications that are in line with the state law according to what I have read. The charter school district is made up mostly of white students in virtual schools. Meaning there is no building and students work out of their homes on computers. They are not real schools at all. No wonder they don’t want Virgin Johnson Academy in the district a real school with real students black and white. The NAACP should look into this matter. I have already contacted them and I am a white citizen who knows right from wrong. What’s going on with Virgin Johnson Academy is wrong! The question is what is the leadership of Virgin Johnson Academy is going to do about it? There is no information on the website. I would suggest: 1) take them to court 2) contact NACCP 3) Contact the education committees in the legislature 4) re-apply if need to. Whatever Virgin Johnson Academy do, know that parents and others are standing with you. We need Virgin Johnson Academy as another choice something outside of public and private education. Dr. Brazell and his board need to correct this fast!

I agree with you Leonard, this situation needs to be investigated by the NAACP or someone. My children are enrolled in Virgin Johnson Academy and I intend to see it open no matter what. I don’t believe in telling parents where to send their children to school but everyone needs a choice rich or poor. I called the charter school district and no one would talk to me so now I am contacting CNN and anyone else who will listen. We the parents have to take this situation in our own hands after all it is about our children. I am not an activist but this time, I will take a stand for my children. I will fight for Virgin Johnson Academy. The truth is that we need the school; I don’t want my children in Estill schools. Do you know that all the principals were fired last week? No one asked the parents what they think or wanted. Even, Mrs. Lee was let go.
I talked to Dr. Nick, she said information on Virgin Johnson Academy position will be posted on their website no later than Thursday.
Virgin Johnson Academy Letter
My level of respect went up for Dr. Nick after reading the letters on the website. She is open and don’t cover up problems. I read the letter from the public charter school district and the letter Dr. Nick sent to Dr. Brazell. She was blunt and stern in voicing her concerns. She is one brave courageous lady. She is an example of hope and prize for the community. Thanks Dr. Nick for sharing the letters with the public. You are what every school administrator should be open and fearless.
